Store Policies     Showroom at Home policy NJModern now offers a "Showroom at Home" policy for customers in the New York City area. "Showroom at Home" allows you to order furniture you want and have it displayed in your home. If at the time it is displayed, you determine that the furniture does not suit your needs, our delivery person take the furniture back. You will be issued a full refund of the purchase price minus a nominal $75.00 handling fee. The following terms apply: Delivery must be to the New York City or Metro New Jersey area only "Showroom at Home" applies to furniture from our "Ready to Ship" selection only Although we make every effort to satisfy our clients using our Showroom at Home service, NJM makes no guarantees for the accuracy of the Ready to Ship selection. NJM is not obligated to provide the "Showroom at Home" service and offers this on a "case by case" basis. NJM reserves the right to deny the service at its sole discretion at any time for any reason Once the furniture is displayed and you may either return the furniture or keep it. If you keep it, all other return policies apply Shipping charge is non-refunable return and exchange All items are covered for 6 months for defects. If the item breaks from regular use, (not including, customer inflicted chips, scratches, cracks, tears, etc.) under our 6 month guarantee we will exchange the damaged item. The customer must provide the proof of purchase in addition to the damaged item in its entirety. We will not accept a partial exchange, all of the pieces of the item must be returned to NJModern. The total of the return and exchange shipping fees will be divided equally between NJModern Furniture and the customer. Variations in color of wood and marble are considered normal and will not be considered defective. Although we try to correctly represent colors and dimensions-given certain limitations, we can not guarantee correct dimensions or, that colors will appear as they do on a computer monitor. Items picked up at our warehouse (will call): NJModern does not maintain a showroom. However, we understand that customers may want to "inspect" items before committing. We have created a policy that we believe protects both the customer and the vendor so that we may continue to offer great furniture at great prices. Customers may, after purchase inspect their merchandise during pick up. At this time the customer may request a full refund for any normally stocked item if, for any reason they are not satisfied with the quality of the merchandise so long as the following are met: Merchandise must be accompanied by original receipt, intact, new, and unused, in its original packaging also intact, with all the documentation, parts and accessories and no more than 5 calendar days having passed since the time of purchase. NJM will assess a 15% re-stocking fee if an item for pick up is held for more than 5 calendar days from date of purchase or, if the item, box, or packaging has been damaged in any way or showing any signs of use after being handled by the customer during pick up. Items being shipped: If you are not satisfied with any stocked item that was purchased from us and shipped to you, that item may be returned for store credit minus 15% within 10 days of date of delivery only if the following are met: must be returned to us (shipped) accompanied by original receipt, intact, new, and unused in its original packaging with packaging intact, with all documentation, parts and accessories and showing no signs of use on the merchandise or packaging to ensure full credit. New and unused means it must be in salable condition as new, not used, dirty or washed. We will not issue credit for any item that is not resalable as new or showing any signs of use. Returns not in original packaging, or items that are, or have been assembled will not be accepted for return. When an item is returned to us and the above requirements have not been met, the customer must make arrangements to pick up the item that has not been accepted for return. NJM reserves the right to refuse exchange or refund of items that are not in as-new condition due to damage or misuse by the customer. All discounted items are final sale with no refund or exchange. Any item that is not in stock at time of purchase is considered a Custom Order. Custom Orders must be paid by check ONLY and are non-refundable. Shipping Do not accept Delivery of your shipped item if it is damaged, if there is an error, or if it is not what you ordered. Signing for a package by the customer or anyone assigned with the responsibility (such as friend, relative, roommate, doorman, etc.) is your agreement that it has been inspected thoroughly and agrees to accept it as undamaged and in good condition. If after a package has been signed for and a customer then wants to make a claim they must do so with the shipping carrier. NJModern will not accept any claim that has been signed for in good order upon delivery. If the item has been shipped, and upon immediate inspection, after removal from packing materials, there is damage or defect not attributable to shipping, then the customer must contact NJModern immediately. Do not sign for the package unless it is in good order. NJModern may request photos of any damages so that it may a determination as to cause of damage. Unless the customer can provide such photos, NJModern can not evaluate the damage and therefore is not obligated to make repairs or provide a replacement. If NJModern determines that the merchandise was damaged or defective prior to shipping, NJModern will replace the item and will be responsible for the shipping fees, both ways. If the item was damaged from the shipping carrier, via evidence of damage on the box or crate, the customer must deal with the shipping agent exclusively themselves. This determination is at NJModern's sole discretion. Exchange will be granted only if an item is defective or damaged prior to acceptance by the customer. If an item is deemed defective or damaged it is up to the discretion of NJModern as to whether the item can be repaired, replaced or a credit should be issued. Please inspect your item carefully at time of purchase or time of delivery as there will be no credit, exchange or refunds on merchandise that has been accepted by the customer. order cancellations When an order is placed NJModern incurs charges for processing that order. Subsequently when an order is cancelled and refunded NJModern is charged again. Therefore there is a 15% Order Cancellation fee if you decide to cancel an order that may not have shipped. assembly Some items may require assembly. NJModern is not responsible for the assembly of any item purchased from us. If for some reason an item can not be assembled because of a damage or defect then a replacement, repair or credit will be issued at the discretion of NJModern. liability limitations NJModern, LLC, its agents, owners, subcontractors or representatives cannot be held liable for any damage to internal electronic or mechanical items. NJModern, LLC has the right to inspect and repair any alleged damage and provides no coverage for cosmetic damage to any items. NJModern, LLC cannot be held liable or negligent for any damage to the interior or exterior of any residence including, but not limited to walls, hardwood floors, flooring, ceilings, landscaping, sprinklers, plumbing, electrical wiring, door frames, doors, lighting fixtures, etc. Any customer who purchases from NJModern agrees to fully indemnify NJModern, LLC, its agents, owners, subcontractors or representatives from any lawsuits or claims arising out of property damage or personal injury occurring during the use, transport (to and from the destination address), delivery, and loading or unloading, where said claim occurred on any private property (condo complex, apartment complex, mobile home park, commercial building etc.) where NJModern, LLC was invited onto by customer to perform services. special order items All Special Order items must be paid for in advance. Special order items will not be accepted for return for exchange or refund. Cancellations of Special order items may be accepted within 3 days but a charge of 15% at the discretion of NJModern. warehouse pick-up policy NJModern, LLC does not assume responsibility for fitting furniture into the customer's vehicle. If customer decides to return furniture for any reason, he/she is responsible for transporting goods back to us. No refunds will be processed until items are returned to us in their original packaging. If original packaging is not provided, no refund will be processed. Customer is responsible for inspecting all items for damage before leaving the pick up facility. delivery policy NJModern may provide delivery service at its discretion if within a 50-mile radius. We want to assist in getting your purchase to you, however NJM is not obligated to provide a shipping service for your purchase. Although we try to provide affordable and timely shipping carriers, any delivery or shipping service of customers choice can be used. Your delivery time and date is scheduled at the point of sale or soon thereafter. If you need to change your delivery time or date after you have finalized your purchase, contact NJModern at least 48 hours before your scheduled delivery time, or a new delivery fee will be charged if NJM has already loaded your order onto a delivery truck. Unless specifically stated otherwise, all deliveries from NJM selected carriers are curbside only so please make any arrangements to ensure the proper placement of your merchandise. An authorized adult must be home during your scheduled delivery window to accept and inspect your delivery and sign the delivery ticket. If no authorized adult is home to receive your scheduled delivery, you will be charged a new delivery fee to reschedule a second delivery attempt. NJM reserves the right to schedule a service technician to repair any imperfection noted at the time of delivery. White glove delivery service may be available upon request. Your purchase acknowledges your awareness and agreement of aforesaid store policy.
